The agreement between you and Narro LLC for Trax.

The short version

Trax is an app that records the miles you drive so you have a log at tax time. You license it, you do not buy it. Your trips are worked out on your phone and stay there.

Trax Pro is a paid upgrade. Monthly and annual plans renew on their own until you cancel; Lifetime is a single payment that never renews. You cancel in the App Store, not with us.

Trax gives you a record. It does not give you tax advice, and what you claim on a return is your call and your responsibility.

The rest of this page says the same things with the precision a contract needs. If anything here is unclear, email help@trax.sh before you buy.

1. Who this agreement is with

These Terms of Use ("Terms") are a binding agreement between you and Narro LLC ("Narro", "we", "us"), the developer of Trax ("the app"). They cover the app, the Trax website, and any service we provide through either.

By downloading, installing or using Trax, you accept these Terms. If you do not accept them, do not use the app.

You must be at least 18 years old, or the age of majority where you live, to use Trax and to buy Trax Pro.

2. Your licence to use Trax

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Trax on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. That licence is what you receive when you download or pay for the app. Ownership of the app itself stays with us.

You may not sell, rent, sublicense, redistribute or share the app; copy or modify it; reverse-engineer, decompile or disassemble it, except where law expressly permits it despite this restriction; remove any notice of ownership from it; or use it to build a competing product.

Trax, the Trax name and the Trax marks are ours. Nothing in these Terms transfers them to you.

3. Your account

Some features need an account. You are responsible for keeping access to it secure and for what happens under it. Tell us at help@trax.sh if you believe someone else has your account.

You can delete your account from inside the app. Deleting it removes your record on our servers. Trips recorded on your device are stored on your device, and deleting the app removes them with it.

4. Trax Pro, plans and prices

The core of Trax is free. Trax Pro unlocks the paid features listed on the pricing page and inside the app.

Trax Pro is sold as a monthly plan at $11.99 per month, an annual plan at $99 per year, and Lifetime, a one-time purchase of $249. Those are the current prices in the United States. The price, currency and billing period that apply to you are the ones shown on the plan you select at the moment you buy, and those prevail over any figure quoted here or elsewhere on the site.

Prices may change. A change never applies to a purchase you have already made, and never to a renewal without notice given in advance in the way the App Store requires, which gives you the chance to cancel first.

A free trial, where one is offered, converts into a paid subscription at the end of the trial unless you cancel before then. If you subscribe while a trial is still running, the unused part of that trial is forfeited.

5. Auto-renewal and cancellation

Monthly and annual plans are auto-renewable subscriptions. Payment is charged to your Apple Account at confirmation of purchase.

Your subscription renews automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. Apple charges the renewal within the 24 hours before the period ends, at the price of the plan you are on.

Manage or cancel in Settings › your name › Subscriptions on your device, or through the App Store. We cannot cancel a subscription for you, and uninstalling the app does not cancel it.

Cancelling stops the next charge. Trax Pro keeps running until the end of the period you have already paid for, and then the app returns to the free version. Trips you recorded while subscribed remain yours and stay on your device.

Lifetime is a single payment. It does not renew and there is nothing to cancel. It is tied to the Apple Account that bought it and can be restored on devices signed in to that account.

6. Buying outside the App Store

In some regions Trax offers the option to pay on our website instead of through the App Store. Those payments are processed by Stripe, and Stripe’s terms and privacy policy apply to the payment itself. We never see or store your full card details.

A purchase made on the web is not an App Store transaction. Apple does not handle its billing, its renewals or its refunds, and it cannot be managed in your Apple Account subscriptions. Manage or cancel it through the link in your receipt or by emailing help@trax.sh.

Whichever way you paid, the same Trax Pro features and the same Terms apply.

7. Refunds

Purchases made through the App Store are refunded by Apple under its own policy, not by us. Request one at reportaproblem.apple.com. We have no ability to issue, approve or refuse an App Store refund.

For a purchase made on our website, email help@trax.sh and we will handle it directly.

Nothing here limits a refund or cancellation right that consumer law in your country gives you and that cannot be contracted away.

8. What Trax is not

Trax is a record-keeping tool. It is not a tax preparer, an accountant or a legal adviser, and nothing it produces is tax, legal or financial advice.

Mileage rates, deduction rules and record-keeping requirements change and differ by country and by year. You are responsible for checking that what you file is correct, and for keeping whatever records the tax authority you answer to requires. Check anything material with a qualified professional.

We do our best to make the logs accurate, but GPS, motion sensors and battery-saving behaviour on a phone all have limits. Trips can be missed, split, merged or measured imprecisely, which is why the app lets you review and correct them. Review your log before you rely on it.

9. Location data and privacy

Trax needs location access to record trips, including in the background. You grant that permission on your device, and you can withdraw it at any time in iOS Settings. Withdrawing it stops the app recording trips.

Routes are worked out on your phone and stay there. We do not receive your trips, sell location data or hand it to ad networks or brokers. The privacy policy sets out exactly what we do and do not collect, and it forms part of these Terms.

10. Acceptable use

Use Trax lawfully. Do not use it to track another person without their knowledge and consent, to break into or disrupt our systems, to work around the paywall or any technical limit in the app, to scrape or resell what the app produces, or to create records you know to be false.

Do not operate the app in a way that takes your attention off the road. Follow the law where you drive.

We may suspend or end access that breaks these rules.

11. Availability and changes

We may change, add or remove features, and we may release updates that your device installs. We may stop offering Trax, or a part of it, at any time.

If we discontinue Trax entirely, we will give reasonable notice and, where a Lifetime purchase was made recently enough that ending the service would be unfair, we will offer a proportionate refund for it.

The app depends on your device, its operating system, its sensors and, for some features, a network connection. We do not promise it will be available or error-free at all times.

12. Disclaimer of warranties

To the fullest extent the law allows, Trax is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement.

Some jurisdictions do not allow certain warranties to be excluded. Where that is so, this section applies to the extent permitted, and you may have rights that it does not affect.

13. Limitation of liability

To the fullest extent the law allows, Narro is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data, or a tax deduction disallowed, reduced or penalised, arising out of your use of Trax.

Our total liability for any claim relating to Trax is limited to the greater of $100 or the amount you paid us for Trax in the twelve months before the claim arose.

Nothing here excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.

14. Termination

You may end this agreement at any time by deleting the app and, if you subscribe, cancelling in the App Store.

We may suspend or end your licence if you materially breach these Terms. On termination, your right to use the app stops. Sections that by their nature should survive — the licence restrictions, the disclaimers, the limitation of liability and the governing law — survive it.

15. Apple

This agreement is between you and Narro LLC only. It is not with Apple, and Apple is not responsible for Trax or its content.

Narro, not Apple, is solely responsible for maintenance and support of Trax. Apple has no obligation to provide either.

In the event Trax fails to conform to any warranty that applies, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation of any kind with respect to Trax.

Narro, not Apple, is responsible for addressing any claim by you or a third party relating to Trax or your use of it, including product liability claims, any claim that Trax fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar law.

Narro, not Apple, is responsible for the investigation, defence, settlement and discharge of any claim that Trax or your use of it infringes a third party’s intellectual property rights.

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

You must comply with any applicable third-party terms of agreement when using Trax.

Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of them Apple has the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.

16. Changes to these Terms

We may update these Terms. When we do, we will change the effective date at the top of this page, and for a material change we will give notice in the app or by email before it takes effect.

Continuing to use Trax after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the app and cancel any subscription.

17. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Delaware, and you and we consent to their jurisdiction.

If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your country of residence, or of the right to bring proceedings there where that law gives it to you.

If any provision of these Terms is held unenforceable, the rest stays in force.
